AZ Real Estate Photography LLC —Terms of Service

By booking a service, paying an invoice, or using any media provided by AZ Real Estate Photography LLC, you agree to the following Terms of Service.

Property Condition & Preparation 

All properties are photographed AS IS at the time of arrival. AZ Real Estate Photography LLC does not clean, stage, or rearrange personal items, aside from small adjustments such as moving a paper towel holder, toilet paper rolls, or other minor objects.

Retouching is performed only for accuracy — not to misrepresent the property. We do not:

  • Change paint or surface colors

  • Add or remove grass or landscaping

  • Remove permanent fixtures, damage, clutter, or structural elements

  • Add décor, furniture, or features that do not exist

The property must be 100% photo-ready before the photographer arrives.
A prep checklist is available upon request and on our website.

Agents should arrive 15 minutes before the appointment to ensure the property is fully prepared and all lights are turned on if they plan to be present during the shoot.

All media reflects the photographer’s artistic style. By booking, the client accepts this creative interpretation as seen in our portfolio and social media. Special preference-based requests may require additional shooting or editing fees.

Payment Terms

Invoices are due upon receipt.
Media is released only after full payment is made.

If a session is split into multiple visits (e.g., twilight return trips), the full session price is billed at the initial appointment.
Return-trip fees may apply.

Invoices must be paid within 72 hours; late fees may be added at the Company’s discretion.

The Company reserves the right to withhold all media until payment is complete.

Cancellations, Rescheduling & No-Shows

  • Rescheduling

  • Minimum 4 hours notice required.

  • Weather-related rescheduling is free.

  • Drone services may be postponed if conditions are unsafe or violate FAA rules.

  • Cancellations / No-Shows

  • Same-day cancellations or failure to provide access to the property may result in being charged the full session fee.

  • Arriving more than 20 minutes late without communication may be considered a no-show.

The Company is not responsible for delays caused by gate codes, lockbox issues, access problems, or miscommunication between agent and homeowner.

Inclement Weather Policy - Monsoons, Dust Storms & Severe Conditions

  • No sessions will occur when temperatures exceed 117°F.

  • Drone services will not be performed above 110°F.

  • If weather is unsafe, rescheduling will occur at no cost.

  • If the agent chooses to proceed, images and video will be delivered AS IS, and weather-related retouching will not be provided.

Deliverables & File Formats

  • RAW photos or RAW video files are never provided.

  • MLS-ready images are included with photography services.

  • High-resolution files may be purchased for $75

  • Videos are delivered in branded and unbranded formats.

Standard turnaround times:

  • Photos: 24–48 hours

  • Videos: 48–72 hours

  • Social media reels: 48+ hours

Rush delivery may be available for an additional fee.

Revisions & Additional Editing

Advanced edits such as object removal, decluttering, color changes, or preference-based adjustments are billed at:

$150 per hour (1-hour minimum).

Revision requests must be submitted within 72 hours of delivery.

Copyright & Licensing

All media produced by AZ Real Estate Photography LLC is fully owned and copyrighted by the Company.
Clients do not own the media.

Clients receive a limited, non-exclusive, non-transferable license to use the media solely to market the property for which it was created.

Clients may NOT:

  • Edit, crop, filter, or alter the media

  • Provide the media to homeowners, builders, contractors, stagers, or other agents

  • Resell, transfer, or gift the media

  • Use photos/video for future listings or personal branding without written permission

Unauthorized usage violates U.S. Copyright Law (17 U.S.C.) and may result in legal action.

Licensing buyouts or expanded usage rights can be requested separately.

Media may only be used for the active listing period of the hiring agent. Any change in representation requires a new license.

Attribution

If any media created by AZ Real Estate Photography LLC is published in print, online, or through third-party outlets, attribution is required in the form of:

“Photo by AZ Real Estate Photography LLC”
or
“Photography by AZ Real Estate Photography LLC.”

Please notify us if your images will be published.

Reshoots

Reshoots due to property readiness, staging changes, or client preference are billed at:

75% of the original session price.

Reshoots required due to Company error are complimentary.

Safety, Drone Laws & Compliance

All drone services comply with FAA Part 107 regulations.

The Company may decline drone operations if:

  • Airspace is restricted

  • Weather conditions are unsafe

  • Obstacles, crowds, or hazards are present

  • Flight would violate FAA rules

The client is responsible for ensuring lawful access to the property.

Limitation of Liability

To the fullest extent permitted by law, AZ Real Estate Photography LLC is not liable for:

  • Lost listings, lost sales, or reduced marketing performance

  • Delays caused by weather, access issues, or emergencies

  • Pre-existing property damage or unsafe conditions

  • Scheduling or communication issues

  • Any indirect, incidental, consequential, or punitive damages

Total liability shall not exceed the amount paid for the specific session.

Client Responsibility & Indemnification

Clients agree to:

  • Provide safe and legal access to the property

  • Ensure the property is hazard-free

  • Obtain homeowner/tenant permission

  • Provide accurate and truthful information

    Clients agree to indemnify, defend, and hold harmless the Company from any claims, damages, or expenses arising from:

  • Unauthorized use of media

  • Safety hazards or property conditions

  • Violations of FAA regulations

  • Misrepresentation or negligence by the client

Force Majeure

The Company is not liable for delays or cancellations caused by events beyond its control, including:

  • Weather

  • Illness or emergencies

  • Equipment failure

  • FAA restrictions

  • Natural disasters

  • Power outages

  • Transportation issues

Sessions will be rescheduled at the earliest available time for no charge.

Acceptance of Terms

By booking a session, paying an invoice, or using our deliverables, the client acknowledges and agrees to all Terms of Service listed above.
